Lifeguard privacy statement

This privacy statement is to be read in conjunction with the privacy statement of ‘Johan’ regarding the use of the portal named ‘Johan’. It specifically outlines the purposes and use of your data collected by Lifeguard within the program offered in collaboration with your employer.

Purpose of data collection

Lifeguard collects your contact and personal details, particularly your name and email address, either provided by you directly or via your employer. These details are used to invite you to participate in the program, provide personalized feedback, and share relevant program information with you.

Lifeguard may also collect information regarding your perceived health and vitality. This includes data you voluntarily submit via questionnaires, as well as the results of any health checks you choose to participate in. These insights are intended to support both you and your personal coach in gaining a clearer picture of your health and vitality.

If your program includes personal coaching, your coach will have access to this vitality-related data to guide you as effectively as possible.

In addition, Lifeguard collects process data on your participation in questionnaires, coaching sessions, health checks, and training sessions. This data is used to inform your employer about overall participation levels. However, this information is never traceable back to you or any individual participant.

Use of data

Aggregated results from questionnaires and health checks may be compiled into anonymized reports shared at the organizational or departmental level with your employer. These reports are based on groups of at least fifteen participants and never include individual data.

Furthermore, Lifeguard may use anonymized data for statistical research. This data can never be linked back to any individual. Lifeguard will never share your information with any third party without your explicit consent, apart from the parties mentioned above.

Conditions for data use

  • Lifeguard processes your data carefully and responsibly, in accordance with the General Data Protection Regulation (GDPR).
  • We will not process any data without your explicit consent. That means we do not collect data unless you have agreed to the privacy policy upon first login.
  • All personal data is treated confidentially and subject to a duty of confidentiality.
  • You may request to modify or delete your data at any time by contacting support@johan.nl.
  • If you do not log into your account after creating it, it will be automatically deleted after two years. You will receive a notification in advance, allowing you to prevent deletion if desired.

Lifeguard complaints procedure

Lifeguard is committed to delivering high-quality service. If you are dissatisfied with any aspect of our services, we encourage you to first reach out to your Lifeguard contact person.

If you wish to file a formal complaint, Lifeguard has a clear complaints procedure in place to ensure your concern is addressed properly. We value complaints as opportunities to learn and improve our services for both clients and participants.

1. Submitting a complaint

You may submit your complaint in writing by emailing info@lifeguard.nl or by sending a letter to: Lifeguard, Newtonlaan 285, 3584 BH, Utrecht, attn: Management.

Written complaints help us avoid any misinterpretations. You may also submit your complaint via the contact form on our website. You will receive confirmation of receipt within three working days.

2. Complaint handling

Your complaint will be reviewed by the designated complaint coordinator, who may contact you for further clarification. The coordinator will also consult any relevant Lifeguard staff involved in the issue.

3. Resolution

Based on the gathered information, the complaint coordinator will make a determination.
If the complaint is (partially) upheld, Lifeguard will outline the corrective actions to be taken. If the complaint is (partially) not upheld, a clear explanation will be provided. You will receive written confirmation of the decision.

4. Disagree with the outcome?

If you do not agree with the resolution, you may submit a written objection to Lifeguard’s management within one month of receiving the decision. You will be invited to present your case in person. A final written response will be provided within one month following the meeting. You may also contact the management directly if you are dissatisfied with the way your complaint was handled.

5. Exceptions

 

The following situations are not covered under this complaints procedure:

  • Dissatisfaction with advice provided by an occupational physician or related specialists. In such cases, you may request a third-party assessment (so-called “expert judgment”) from the Dutch Employee Insurance Agency (UWV).

  • Claims related to financial damages you believe to have suffered due to Lifeguard’s actions. In that case, please send a liability notice to info@lifeguard.nl
